Topic: Expert Submissions, Claims, Defenses and Ethics
Speaker: James E. Smith l Shareholder, Crain Caton & James
A certificate for one hour continuing education credit will be provided to all attendees.
The presentation will address potential liability that environmental professionals might face from claims brought based on their work as experts or expert witnesses. It will also address the responsibility of expert witnesses to the forum where they testify or submit reports, including the potential for the judge or other presiding officer to sanction an expert witness and or hold the witness in contempt. It will identify defenses that might be available to the environmental professionals in the event claims are asserted but will also discuss the limits of those defenses both in Texas and in other states. Finally, it will address some of the ethical rules that environmental professionals should consider when practicing before a court or state agency. While the focus will be on Texas, the presentation will mention other states, particularly those that appear to be less protective of technical professionals.

Jim principally focuses on environmental and safety matters including defense of enforcement actions, cost recovery, compliance counseling, and supporting transactions. Included in his environmental litigation experience are civil and criminal trials in state and federal court, both jury and non-jury, and numerous contested cases before TCEQ and other administrative agencies. He has argued appellate matters before the U.S. Court of Appeals for the Fifth Circuit, the Supreme Court of Texas, and several intermediate Texas appellate courts.
